Kroy ‘KJ’ Biermann Jr., the 15-year-old son of reality television star Kim Zolciak and former NFL player Kroy Biermann, has been indicted on seven felony charges related to an alleged sexual assault . His attorney, Jason Sheffield, has responded to the indictment by stating that the full details of the case cannot be presented yet due to the early stage of the legal proceedings .
A Fulton County grand jury returned the indictment on September 3, 2026 . The charges include one count each of aggravated child molestation, aggravated sexual battery, aggravated sodomy, and false imprisonment, as well as three counts of sexual battery against a child under the age of 16 . KJ is being charged as an adult under Georgia’s SB440 law .
The indictment stems from an alleged incident that occurred on April 23, 2026, at a Life Time Fitness facility in Alpharetta, Georgia . According to court documents, KJ allegedly led a 15-year-old female acquaintance into a family changing room, where he restrained her and forced her to engage in non-consensual sexual acts . KJ was arrested on August 17 and has been held without bond at the Metro Regional Youth Detention Center .
In a statement, Sheffield explained why the full details of the defense cannot be heard at this time. ‘I respect the difficult responsibilities carried by prosecutors and victim advocates,’ Sheffield said . ‘Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues’ .
Sheffield noted that the arrest and indictment have only presented one side of the story. ‘An arrest and an indictment cannot tell us the whole truth of a case because, at those stages, the magistrate judge and the grand jury have heard only one side,’ he said . ‘The accused has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding’ .
Sheffield emphasized the importance of understanding the context of his client’s age. ‘There are two children at the center of this case. KJ was 14 years old when these events allegedly occurred,’ Sheffield said . ‘He was arrested at 15 and, less than three weeks later, indicted on charges carrying extraordinary consequences. But adult consequences do not transform a child into an adult’ .
KJ’s legal team has consistently maintained his innocence. ‘Without DNA evidence, the case remains one of ‘she said, he said’ and the credibility of the accuser,’ Sheffield said . ‘The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations’ .
Kim Zolciak has publicly defended her son, calling the allegations ‘reckless and deeply troubling’ . In a statement, she said, ‘He categorically denies ever being involved with this woman or engaging in the conduct she has alleged’ . She also noted that her son voluntarily took a polygraph examination regarding the allegations and passed, and that an examination found no male DNA belonging to her son on the alleged victim .
KJ’s attorneys have filed a motion requesting his release on bond, citing his substantial ties to his family and community . A court hearing is scheduled for September 9 . Sheffield has expressed hope that the case will ultimately be heard in juvenile court .
